New ACAS guidance on handling TUPE transfers
ACAS has this week published guidance for employers on how to handle TUPE transfers. Although it runs to 74 pages, it is helpful as a starting point with some useful examples.
If you are not familiar with TUPE it refers to the Transfer of Undertakings (Protection of Employment) Regulations 2006, which have recently been amended this year. They apply to some transfers of business, and also when there is change of service provider ( e.g. contracting out, or in, of services). TUPE protects employees on transfer amd they will automatically transfer to the new employer if TUPE applies to their situation.
